根据《EB-5改革与诚信法案》，美国移民局USCIS必须依据现行法律，审查9月30日前递件之移民申请案件。易言之，即使未来法律修改、投资金额提高，甚至投资移民政策停止授权，亦不影响已递交之案件。

9月30日后递件之案件，即不受法律不溯及既往的原则保障，申请人或面临更全面资金合法来源证明标准、更严苛创造就业机会要求，乃至于高达140万美金之投资门槛条件。更甚者，美国移民局USCIS或不受理后续递件之移民申请案件。

“Notwithstanding the expiration of legislation authorizing the regional center program […], the Secretary of Homeland Security shall continue processing petitions […] based on an investment in a new commercial enterprise associated with a regional center that were filed on or before September 30, 2026.”
